Atlanta employment law attorneys, Martin & Martin, is a boutique law firm in Atlanta, Georgia founded by the father/daughter duo Thomas F. Martin and Kimberly N. Martin who passionate about representing employees and a select number of small businesses in matters related to employment, wage & hour, and corporate laws.
Thomas F. Martin grew up in Queens, New York playing basketball at LaSalle Academy prior to being recruited to play basketball for the United States Naval Academy at Annapolis, Maryland. Upon graduation from the Naval Academy, he served in Vietnam for a year on river patrol boats (PBRs) on the rivers and canals of the Mekong Delta. After active duty, Tom began a very successful health care career as a senior executive of several hospital corporations that lasted for 28 years and provided him with a wealth of experience in a wide variety of management and senior administrative and executive roles. Tom has operated in both the proprietary as well as the not-for-profit segments of the health care industry, and has had many very successful experiences with start-ups, takeovers, and turnarounds.
Known as “the fixer,” Tom was the one chosen by national hospital corporations for takeovers and turnarounds, requiring him to step into very poorly performing hospitals and making them profitable in a short period of time. Tom also has experience in many corporate start-ups and performing legal due diligence evaluations. Tom’s senior executive career gave him knowledge and experience that is incomparable to other lawyers. Tom attended and graduated law school after he retired from his decades long impressive career as a senior hospital executive.
Atlanta employment law attorney, Kimberly Martin, graduated with honors from the University of Florida College of Law where she received the “Book Award” for Employment Law indicating the highest grade in the class. After graduating from law school, Kimberly returned home to Atlanta where she worked at several large national and international law firms representing employers in arbitration and litigation involving all aspects of employment law including Charges of Discrimination at the Equal Employment Opportunity Commission (EEOC); sexual harassment, discrimination, and retaliation lawsuits filed in federal court; Family Medical Leave Act (FMLA) violations; as well as overtime and wage claims under the Fair Labor Standards Act (FLSA) involving hundreds of employees across the country.
For five years, Kimberly not only provided litigation defense to large companies, she provided day to day legal advice and counsel to corporate vice presidents and in-house general and associate counsel on employment law and wage and hour law topics including sexual harassment investigations; FLSA job position exempt/non-exempt status audits; drafting non-compete and restrictive covenant agreements and non-disclosure agreements (NDA); drafting and negotiating severance agreements; providing legal counsel on determining reasonable accommodations under the Americans with Disabilities Act (ADA); performing due diligence in preparation of a corporate sale or purchase; and drafting corporate policies and procedures. Representing large employers throughout the country, Kimberly gained unique and invaluable knowledge and experience that she uses today at Martin & Martin, representing employees and a select number of small businesses in all areas of employment and wage & hour laws.
In 2007 Tom and Kimberly formed Martin & Martin, an Atlanta employment and wage & hour law firm representing employees and small business in all aspects of employment and wage & hour laws. They have now practiced together for over fifteen years successfully representing hundreds of employees and a select group of small businesses. Through the past fifteen years, they have maintained their unwavering determination to fiercely fight on behalf of the “good guys.”
Representation of EmployeesOne of the firm’s founding principles is being unapologetically aggressive in fighting for every penny that their clients deserve. This means that lawyers, Kimberly Martin and Tom Martin, do not run a “litigation mill;” representing hundreds of clients at the same time hoping to win a few cases. They handle fewer cases with the goal of winning every single one of them. And, pursuant to federal law, if successful, Kimberly and Tom seek to recover most, if not all, of their attorney’s fees and costs of litigation from the employer – not their employee clients. Many times, Kimberly and Tom agree to receive reduced attorney’s fees and reimbursement of litigation costs if it means a better settlement for their clients.
And, their strategy has worked. Over the past fifteen years, Kimberly and Tom have successfully represented hundreds of employees in all types of employment and wage & hour law cases, including FLSA Wage & Hour, Hourly Employees, Salaried Employees, Tipped Employees, Independent Contractors, Commissioned Employees, FLSA Retaliation/Whistleblowers as well as Employment Law, Discrimination, Disability Discrimination, Age Discrimination, Pregnancy Discrimination, Equal Pay, Employment Law Retaliation/Wrongful Termination, and FMLA violations. They routinely represent groups of employees in class actions/collective actions when employers target a group of employees for improper overtime exempt classification under the FLSA or illegal discrimination, including corporate reductions in force (RIF) targeted at employees on the basis of age.
Martin & Martin, Atlanta employment law and overtime attorneys, Kimberly Martin and Tom Martin, have filed lawsuits against national and international companies like Home Depot, FedEx Ground Package System, Ethan Allen, Chili’s Bar & Grill, and Diligent Delivery Services, as well as numerous Georgia companies like Emory University. Some of their cases have received media attention and they obtained the second highest jury verdict in the state of Georgia for the year for a sexual harassment and retaliation case that they litigated on behalf of an employee who was terminated after she complained about sexual harassment at work.

Representation of Small BusinessesOver the past fifteen years, Atlanta small business attorneys, Tom Martin and Kimberly Martin, have developed a very successful small business laws practice representing small businesses throughout the state of Georgia. In 2022, they created the Georgia Small Business Employment Law Training Center, a division of Martin & Martin, to provide information and resources to small businesses in Georgia. Tom and Kimberly represent some of their small business clients essentially as their “in-house” counsel providing day-to-day advice on corporate and employment law matters. Tom and Kimberly represent other small businesses as “outside” counsel, defending the small businesses against alleged legal claims at the Department of Labor (DOL), the Equal Employment Opportunity Commission (EEOC), mediation, arbitration, and litigation.
Georgia small business laws attorneys, Tom and Kimberly, founded their Small Business Laws practice on the principle that small businesses should not be excluded from outstanding legal advice and counsel due to their inability or lack of desire to pay attorneys extraordinary hourly rates of $1,000+ with the primary goal of enriching the partners of a large law firm. Instead, Tom and Kimberly are proud to provide their small business clients with concrete, solid, legal advice and strategies that their clients would receive from a large law firm but at a fraction of the fees and costs; they are uniquely able to do this based on Tom’s decades long career as a senior executive at regional and national hospital companies and Kimberly’s five years representing large companies in all matters of employment and wage & hour laws. Tom and Kimberly offer their small business laws clients very reasonable hourly rates as well as monthly retainer fee agreements that allow their clients to contact them whenever a potential legal issue arises.
Atlanta small business attorneys, Tom and Kimberly, believe in best practices and understand that small businesses want to do the right thing, but sometimes make mistakes. These mistakes, however, should not cost a small business their entire company. Tom and Kimberly are proud to advise their small business clients on transactional matters including contracts, agreements, restrictive covenants, non-competes, non-solicitations, personnel decisions, sexual harassment investigations, FLSA exempt status reviews and audits, and any type of employment policies and procedures, as well as defend their clients at the DOL, EEOC, arbitration, mediation, and litigation. They also proactively notify their clients of recent law changes and court decisions that could impact their businesses.
